Yesterday, Muslims were waiting for Ramadan, however, today they are saying goodbye to it, as if this month were moments long. And as this month passed quickly, life does, and so people die and move to the hereafter.
The end of Ramadan reminds us with the closeness of death. The end of Ramadan reminds us with the saying of the prophet SAAW, “Live in this world like a stranger or a bye-passer”. During the period of the 9th – 13th days of the month of Dhul Qi’dah 1430, which coincide with the 28th – 31st days of the month of October, 2009, the 6th annu1al conference of the Assembly of Muslim Jurists of America commenced in Montreal, Canada, under the title of: “Contemporary Challenges that Arose Outside the Lands of Islam.”
Throughout the four consecutive days, detailed and elaborate discussions took place around the topics presented to the esteemed members of the assembly and its experts which pertain to Muslims in America particularly and emigrant Muslims at large. قرارات وتوصيات المؤتمر السادس لمجمع فقهاء الشريعة بأمريكا المنعقد بمونتريال – كندا

الحمد لله والصلاة والسلام على رسول الله وعلى آله وصحبه ومن والاه أما بعد:فإنه في الفترة من 9 – 13 من شهر ذو القعدة 1430 الموافق 28 – 1 3 من شهر أكتوبر 2009 في مونتريال بكندا جرت فعاليات المؤتمر السادس لمجمع فقهاء الشريعة بأمريكا تحت عنوان نوازل الناشئة خارج ديار الإسلام.
وقد دارت مناقشات موسعة ومستفيضة على مدى أربعة أيام متتالية حول الموضوعات المقدمة من السادة أعضاء المجمع وخبرائه فيما يشغل المسلمين في الساحة الأمريكية بشكل خاص وفيما يخص ناشئة المسلمين في المهجر بصفة عامة، ونظرا لتغيب بعض السادة أعضاء المجمع عن الحضور لتعذر حصولهم على التأشيرات، فقد خلص المجمع إلى جملة من مشروعات القرارات التي تقرر في اجتماع هيئة الرئاسة بالمجمع تحويلها بريديا إلى سائر أعضاء المجمع لاستقبال تدقيقاتهم إلى العشرين من شهر ديسمبر، ثم تعاد إلى هيئة الرئاسة لتدقيقها مرة أخرى لتصبح قرارات نافذة من تاريخ اعتماد هيئة الرئاسة لها، وقد تم تمديد هذه المدة إلى نهاية ديسمبر بناء على اقتراح بعض السادة الأعضاء، واستقبلت أمانة المجمع خلالها بعض المقترحات وتداولت حولها ثم حولتها إلى هيئة الرئاسة لاعتمادها، وانتهت إلى هذه الصيغة المرفقة.

الحمد لله، والصلاة والسلام على رسول الله وآله ومن والاه، أما بعد،
مع اقتراب دخول شهر رمضان المبارك، وظهور بوادر القلق في أوساط الجاليات الإسلامية المقيمة على أرض الولايات المتحدة الأمريكية من تجدد الخلاف المتكرر كل عام حول ثبوت شهر رمضان وحلول أول أيام الصيام فإن أمانة مجمع فقهاء الشريعة بأمريكا تتوجه بخالص التهنئة إلى الأمة الإسلامية عامة وإلى طلائعها المقيمة في الغرب خاصة وتؤكد على ضرورة السعي إلى الجماعة والائتلاف، ونبذ الفرقة والاختلاف، وأن ما يكره الناس في الطاعة والجماعة خير مما يحبون في الفرقة والمعصية، وتود أن تنبه في هذا الصدد إلى أن قضية ثبوت الأهلة تثير جملة من القضايا الاجتهادية تتمثل فيما يلي:

A number of facts should be mentioned concerning that which arose in relation to the call to rely on astronomical calculations in establishing the start of Ramadan and other months, instead of the moon sighting which has been the established practice of the Ummah over the centuries:
The physical moon sighting as required by Shari`ah is the basic method of establishing the birth of the crescent moon, due to the Prophet’s saying (saws) in the hadith which was related from him by nine of the Sahabah, “When you see the crescent moon, fast, and when you see it, break your fast, and if it is obscured from your vision, complete the month to thirty days.” [Related by Al-Bukhari, Muslim and others] Read More
