Title: Different opinions amongst the AMJA scholars

Question

Alsalam alaikom wa rahmatu Allah wa barakatuh.

 

Dr. Main answered one of the fatwas about Guidance by saying that there are two other members who have approved dealing with Guidance. Then he said, "You can take their opinion if you wish." I would like to ask Dr. Main and the other members of AMJA to make just one opinion for every fatwa, and discuss it before putting it online. We have a lot of confusion and we don't need more confusion by having different opinions from the same source.

All praise be to Allah and may His peace and blessings be on the last and greatest messenger, Muhammad.

 

It is our policy at AMJA not to adopt a collective stance regarding any of the Islamic financial institutions working to serve the Muslim community in the U.S. We highly appreciate their business in providing an Islamic alternative and we leave it up to our Mufteen (fatwa scholars) to make whatever declaration they deem correct in terms of dealing with any particular company.

 

Regarding the company in question, we have various opinions as you have noted, because every Mufti (fatwa scholar) has his own way of evaluating the contract. This is not only based on which juristic school he adopts, but also how each piece of evidence is applicable to the specific contract.

 

As a questioner, you may go with the majority, if you like, or you could continue to ask people of knowledge (scholars) until you adopt a stance. You could also take the fatwa of the whoever you believe has more deep and sound knowledge, for even the eminent companions (Sahabah) of the Prophet (saws) used to differ on certain issues where there was no explicit and clear evidence to guide them. Indeed, one time a difference of opinion happened [among the Sahabah] during the time of the Prophet (saws) himself and he did not shun or even condemn them because of it.
