Question

Assalamu alaykum wa rahmatu Allah wa barakatuh,

 

Our honorable shaikh,

 

According to Islamic law, if someone is responsible for hurting someone else, such as breaking his/her hand or making someone lose his/her vision, does the Islamic court have the right to punish him in the same way as what he has committed?

Answer

Yes, the Muslim authority (if there currently is any) would be responsible for the application of the Islamic penal code, of which retaliation, or al-Qisas, is a part. So, if someone has intentionally hurt or injured another person, the Muslim court should do the same to the offender, or even allow the victim to do the same, under the supervision of the court. If similarity in retaliation against the criminal is too difficult to apply, the Muslim judge could decide to charge the offender a financial penalty to be given to the victim.
