Question

Many people say that eating non-zabihah is haram and many say it is halal. I wanted to know why there is a difference in the scholars opinions. Pakistani scholars say it is non permissible while many Arab scholars say it is permissible. so is it ok to eat at fast food restaurants such as mcdonalds, burger king, whataburger, ect. And my mother and I have been discussing over this matter for a while so we wanted to clear it out.i am Pakistani and i agree with scholars from both sides because they both have proof. Could you explain what makes the difference so if someone asks me, I would know the answer in detail.

Answer

Alhamdu Lillah

This classification has no legitimate base in Islam. When a poultry or an animal is allowed Islamically to eat from its meat, was slaughtered according to the Islamic code of slaughtering, and was slaughtered by a Muslim or a person from the people of the book, then the meat is Halal, whether some call it Thabihah or not.

Some math-habs added the obligatory of mentioning the name of Allah (saying: Bismillah) while slaughtering. This is a sound opinion when the slaughterer is a Muslim.

The above are the conditions for the permissibility of any meat. Adding another condition needs evidence.

As of eating from a particular restaurant; if all the aforementioned conditions are met, and there was no obstruction, like using the same utensils used for cocking pork or using lard (pig fat) or the like.

It is recommended that you avoid the fast food restaurants in the US as much as you can, as they do not care about separating pork products from other products, nor they care about using different utensils
