Question
I performed Hajj a couple of years ago and I recall asking my father to allow me to make wudu, but he refused to let me go. Either he possibly refused because of the crowd, or because he knows that I suffer many wiswas. In any case, I did the Tawaf though I may have not had wudu, and I did many Tawaf and Sa’yi (walking between the Safa and Marwa), so should any of that suffice for the Tawaf of Ifadah, or am I required to return to make the Tawaf with a special intention for Ifadah? Thanks.

The answer to your question lies in the principle rule in Fiqh that says, “Certainty cannot be removed by doubt”, and it appears from your question that you had wudu, but your father refused to let you go make wudu again because of the mentioned reasons, suffering from wiswas being one of them. It is most likely that you had wudu at the time and that is a certainty, and your attempt to make wudu is a result of your doubt. Therefore, we deduce the ruling based on the certainty, which is that you had wudu at the time. Based on that, your Tawaf is correct and you are not required to do anything, by the permission of Allaah. Dr. Muwaffaq Al-Ghalayeni.
