Title: | Do I have to pay zakat for the gold which I possess? |
Category: | Poor-due or obligatory charity (Zakaah) |
Scholar: | Dr.Salah Al-Sawy |
Date: | 05/20/2009 |
Peace, Mercy and Blessings of Allah be upon you. I possess gold that amounts to 80 grams. I did not buy it all at once, but I used to buy one or two pieces each year until I gathered this amount. When I bought the gold, I did not intend to trade with it; rather, I intended to put it on for adorning. My question is whether I have to pay zakat for this gold especially that a year has passed, and how to calculate zakat?
May Allah reward you amply.
In the Name of Allah, The All-Merciful, The Ever-Merciful.
Praise be to Allah and Peace be upon Allah's Messenger, his companions, his household and his followers.
There is controversy among scholars on whether paying zakat for jewelry is obligatory; the Hanifites and those who followed them considered it obligatory, whereas the majority did not. However, there are proofs that the view of the Hanifites is more prudent, of which:
- The narration by Lady Aisha (May Allah be pleased with her), "The Messenger of Allah came to me and saw me wearing big silver rings, whereupon, he asked, 'What is this, Aisha?' I replied, 'I made them to adorn myself for you, O Messenger of Allah.' He said, 'Did you pay their Zakat?' I said, 'No, or what Allah wishes.' Then he said, 'Their punishment in Hell is enough for you.'" (Narrated by Abu-Dawud in his Sunan, 155) and authenticated by al-Albany in Abu-Dawud's Sahih).
- The narration by Amr Ibn-Shu'aib after his father, after his grandfather, "A woman came to the Messenger of Allah (PBUH) with her daughter. On the daughter's wrist were two heavy gold bracelets. The Messenger asked her, "Do you pay Zakat on this?" She replied, "No." The Messenger said, "Would it please you that Allah will encircle you with two bracelets of fire?" The reporter commented that she took them off and threw them down in front of the Messenger, and said: "They are for Allah and his Messenger." (Narrated by Abu-Dawud in his Sunan, 1563) and an-Nasa'iy (2479), and authenticated by al-Albany in Abu-Dawud's Sahih).
Zakat becomes due on the jewelry that reached nisab (the minimum amount of wealth on which zakat is imposed) and on which a year has passed. A year is calculated starting the time it reached this minimum. The latter is 20 dinars, equivalent to 85 gms of pure gold. There is no zakat for the gold which did not reach nisab. The zakat is calculated as a quarter of the tenth of the gold which reached nisab to be paid annually every lunar year. May Allah grant you more keenness and guidance. And Allah knows best.
